Well, I would have to partially disagree on that. Process IS neccessary to determine guilt. If guilty, then yes. The problem is, before they
attack, they may well have done nothing but plan, which is not a death sentence crime. After they attack, they are already dead so then it's
too late to do anything about it. It's ugly all around. You can't kill people on suspicion of what they might do someday. But if you wait till
they do it... That's why this is a different kind of war - -it's going to be fought more on the level of intelligence gathering than on any
battlefield, with the exception of areas like Iraq and Afghanistan where WE set the terms and draw them out and engage them - take the
battle to them rather than wait for them to come to our borders.
