If you have the real text of this penalty I can make a search (I'm very busy), so I can ease it a bit.
This penalty depend of the altitude, as you approach ground the limit for penalty is raised.
Commercial aircraft's normal rate is around 1500-3500 FPM, no commercial aircraft do 8000 FPM in normal operation, ~3000 FPM was set for passengers comfort..
